EverDay is published by Krishna Sagar in India. In these terms, “we”, “us”, and “our” refer to Krishna Sagar as EverDay's publisher and application provider.
Agreement and Apple's Standard EULA
EverDay is distributed through Apple's App Store. Your licence to use the app is governed by Apple's Standard Licensed Application End User License Agreement (the “Standard EULA”) unless a different valid licence is shown by Apple for EverDay. These Terms of Use supplement the Standard EULA with product-specific provisions; they are not intended to replace it.
By downloading or using EverDay, you agree to the Standard EULA, these supplemental terms, and applicable Apple Media Services terms. If you do not agree, do not use the app. Mandatory consumer rights and applicable law prevail where they cannot lawfully be limited.
Licence and ownership
EverDay is licensed, not sold. Subject to the Standard EULA, you receive a personal, non-transferable licence to use EverDay on Apple-branded devices you own or control and as permitted by Apple's Usage Rules, including any permitted Family Sharing or volume-purchase access. No ownership interest in EverDay, its design, software, branding, or documentation is transferred to you.
You may not rent, lease, sublicense, redistribute, interfere with, or attempt to derive EverDay's source code except where the Standard EULA or applicable law expressly allows it.
What EverDay provides
EverDay is a personal planning tool for tasks, dates, time blocks, reminders, tags, subtasks, recurrence, widgets, and related information. Features can depend on your device, iOS version, permissions, Apple Account, iCloud availability, network connection, and Apple service status.
EverDay is intended to assist planning. It does not guarantee that a reminder, notification, sync operation, widget refresh, or scheduled action will occur at a particular time. Do not rely on EverDay for emergencies, medication, safety-critical work, or any situation where a missed alert could cause harm.
Your content and responsibilities
You retain ownership of content you enter into EverDay. You are responsible for that content, device access, iCloud security, notification settings, and keeping independent copies of information whose loss would cause harm. Do not use EverDay to store or process content unlawfully or in a manner that infringes another person's rights.
iCloud and Apple services
EverDay uses Apple-provided technologies including CloudKit, iCloud, StoreKit, WidgetKit, App Intents, push delivery for CloudKit sync, and notifications. Apple controls those services. Availability, timing, data propagation, restoration, and device compatibility can depend on Apple's systems and your settings. Apple's terms and privacy policy apply to its services.
Sync is designed for convenience, not as an independent backup guarantee. Conflicts, outages, offline devices, account changes, storage limits, or platform defects can delay or prevent synchronization.
EverDay Pro
EverDay Pro is an optional, non-consumable in-app purchase offered through Apple's In-App Purchase system. The App Store displays the localized price and applicable purchase terms before confirmation. Pro is not a subscription.
Apple processes payment, taxes, billing, purchase history, refunds, and restoration. An eligible purchase can be restored from EverDay Settings using the same Apple Account, subject to Apple's systems and policies. Family Sharing is available only if Apple and the product configuration support it; it is not promised by these terms.
Maintenance and support
We, not Apple, are responsible for EverDay's maintenance and support to the extent required by applicable law. Apple has no obligation to provide maintenance or support for EverDay. Support requests can be sent through everday.app/support or to krsnasgr@icloud.com.
Warranty and refunds
Except for rights or warranties that cannot lawfully be excluded, EverDay is provided on an “as is” and “as available” basis without a promise of uninterrupted, error-free, or loss-free operation. The Standard EULA describes Apple's limited role if the app fails to conform to an applicable warranty. Refund eligibility and processing are determined by Apple and applicable law; Apple has no other warranty obligation for EverDay to the maximum extent permitted by law.
Product and intellectual-property claims
We, not Apple, are responsible for addressing claims relating to EverDay or your possession and use of it, including product-liability, consumer, privacy, or regulatory claims, to the extent required by law. If a third party claims that EverDay infringes intellectual-property rights, we—not Apple—are responsible for investigating, defending, settling, or discharging that claim as required by the Standard EULA and applicable law.
Updates and availability
We may update EverDay to improve it, fix defects, respond to platform or legal changes, or modify features. Some updates may be required for continued operation. We may discontinue a feature or the app where reasonably necessary, subject to applicable consumer law and obligations connected to completed purchases.
No professional advice
EverDay provides general productivity functionality, not medical, legal, financial, employment, or other professional advice. Planner suggestions, timing, and status information should not be treated as professional or safety guidance.
Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive loss arising from your use of EverDay, including missed reminders, unavailable Apple services, or lost planner content. This limitation does not exclude liability or remedies that cannot lawfully be excluded, and it does not reduce rights available under mandatory consumer-protection law.
Legal compliance
You represent that you are not located in a country subject to a United States government embargo and are not listed on a United States government prohibited or restricted parties list, as required by Apple's Standard EULA. You must use EverDay in compliance with applicable local law and any third-party agreement that applies to your device, network, or Apple Account.
Governing law
These supplemental terms are governed by the laws of India, without regard to conflict-of-law principles. Courts with jurisdiction over the publisher's principal place of business will have jurisdiction, except where the Standard EULA or mandatory consumer law gives you the right to bring a claim elsewhere.
Changes to these terms
We may revise these terms as EverDay evolves. The current version and date will remain posted here. Material changes will apply prospectively where required, and continued use after notice constitutes acceptance only to the extent permitted by law.
